Learning outcomes of the course unit:
Gaining knowledge of enforcement law system and its practical mastering in legal practice; perception of the enforcement law as part of the right to judicial protection; and
learning its role in law enforcement or application of laws to solve model examples from practice.
Course contents:
1) Place and importance of civil rights in an enforceable system of law, history, the dual system of judicial enforcement of decisions and execution
2) The legislation enforceable law - the legislative framework, the bailiff - the status, roles, responsibilities, accountability
3) State supervision over the activities of bailiffs; SKE - government, its mission, role and responsibilities
4) The status and activities of the court writ of execution process
5) the herd and conduct enforcement proceedings, the extent of the execution, the parties, the enforcement order
6) Deferment, cessation and suspension of executive actions, excluded matters of execution, protection and defense of the debtor and third parties in enforcement proceedings
7) Payroll
8) garnishment, execution sale of shares
9) Execution sales of chattels and disqualification from driving
10) Execution sale of real estate
11) Payment in kind to Execution
12) Decisions of the Court of Justice of the EU and their application in execution proceedings
