Learning outcomes of the course unit:
Characteristics of matter of consumer law and its development in Slovakia and the EU.
Course contents:
The legislative framework of consumer protection - Consumer Union law, the role of international organizations and sources of law on consumer protection in Slovakia in terms of all the legitimate interests of consumers (protection of health and life of consumers, protection of economic interests, and environmental protection). The institutional framework of consumer protection, public protection and basic knowledge of the control bodies, with emphasis on the specific situation of the Slovak Trade Inspection, is a private protection and alternative dispute resolution for consumer disputes (EP and Council Directive 2013/11 / EU on consumer ADR and the EP and the Council ( EU no. 524/2013 on consumer ODR).Protection of the economic interests of the consumer - in particular the Consumer Protection Act, Directive 1999/44 / EC on certain aspects of the sale of consumer goods and associated guarantees, Council Directive 93/13 / EEC on unfair terms in consumer contracts, EP and Council Directive 2005/29 / EC concerning unfair business-to-consumer market, the EP and Council Directive 2008/122 / EC on the protection of consumers in respect of certain aspects of timeshare, long-term holiday product, resale and exchange contracts (ie. Timeshare Directive), travel packages - Council Directive 90/314 / EEC on package travel, package holidays and package tours, the rights of air passengers (EP and Council Regulation EC) No. 261/2004), bus, rail and water transport, EP and Council Directive 2008/48 / EC on credit agreements for consumers, EP and Council Directive 2011/83 / EU on consumer rights.Product Safety - harmonized area and general safety. The role of market surveillance as a tool to pry the New Approach Directives and the importance of the so-called. New regulatory package for improving the free movement of goods. Liability for damage caused by defective products (Council Directive 85/374 / EEC).Practical examples from practice SOI, court decisions and the appropriate ECJ case law.
